Geez. We have so many more important things to worry about. Tying up the courts. I don't drink very much at all when I am out but with the overprice of drinks I thought the tax was included.

that is the point. . .the charges can be different depending on where you dine . . . .one would think it would be the same across the board. . . like OKC sales tax. . .it's .08375 on what ever you buy. . .just think it should be the same no matter where you eat/drink.

I agree with things being even. I would like to see sales tax on food eliminated. Not wine beer or booze. The diff between establishments that make more money from food that serve drinks as apposed to straight out bars and pubs I'm not qualified to argue either point.

This is someone literally trying to just make a fast buck. I think he went to individual restaurants and said "If you settle with me, I won't include you in the lawsuit".

When you get your bill at the end of the night at a restaurant, it often looks something like this:

Tax >>> $7.87
LBW Tax >>> $2.43

TECHNICALLY the ticket should read something like this, if the restaurant wants to make the cost of their Malbec $10 and their Riesling $8 BEFORE tax:

Malbec >>> $11.35
Riesling >>> $9.08
--------------------------
Sub-total >>> $96.43
Tax >>> $7.87
---------------------------
Total >>> 104.30

What smart restaurants do is keep the liquor tax in the drink and separate the sales tax at the end:

Malbec >>> $12.00
Riesling >>> $9.00
--------------------------
Sub-total >>> $97.00
Tax >>> $7.87
LBW Tax >>> $1.76
---------------------------
Total >>> 106.63


Regardless of what the restaurants list and/or charge, they still pay the 13.5% tax for strong drinks (non 3.2 beer) in addition to the 8.375% sales tax. Some just make the 13.5% tax a line item after the sub-total rather than including it in the price of the drink.
