TMZ has learned that Paris Hilton has not only had her sentence cut short, she is already out of jail!

Unimpeachable sources tell TMZ the deal was sealed yesterday, and that Hilton made her exit early early this morning.

She was originally sentenced to 45 days in jail, but that was reduced to 23. She served a total of three days.

The L.A. County Sheriff's Department will hold a news conference in an hour to discuss what went down.

(I originally saw the "breaking news" headline on MSNBC.com, but they didn't have the story yet, so I went to TMZ.com instead)

Justice for Paris Hilton would have been for her to spend her 23 days living in a homeless shelter. Or serving as a maid in one of the Hilton Hotels (or one of the beautiful 'motel' establishments located on South Shields Blvd - e.g. The Swank Motel) during the day and then spending the night in jail (or the shelter) at night.

For medical reasons, Paris Hilton will serve her sentence at home, according to a spokesman for the Los Angeles County Sheriff's Department.

After serving just three days behind bars, Hilton was "reassigned" to home detention and was sent home with a electronic-monitoring device. In conjunction with her home detention, Hilton's sentence was re-set at 40 days.

What world are some of you people living in? Right here in Oklahoma we have people on their 3rd and 4th DUI that have never been in jail longer than it takes to bail out.

Do you guys have any idea how many cases never even get filled, even though the suspect was arrested?

I hear from police friends routinely how they put so much effort into some arrests, only to have the case never filed.

Right now Oklahoma County has put a hold on all 'cost warrants.' Meaning, if you owe the court money (often times in exchange for not going to jail) they will not issue a warrant for you. You simply get a pass.

While I find Paris Hilton annoying, she's a product of her environment. Should she be in jail? Maybe, but I have no problem with her being released early with conditions.

Life isn't an episode of Law and Order.

Most defense lawyers will tell you, counties rely on fines and fees to make budget. They don't want your body, they want your wallet.

Paris Hilton’s release from jail may be short lived.

Hours after she was sent home under house arrest Thursday for an undisclosed medical condition, the judge who put her in jail for violating her reckless-driving probation ordered her into court to decide if she should go back behind bars.

Hilton must report to court at 9 a.m. Friday, Superior Court spokesman Allan Parachini told The Associated Press.

“My understanding is she will be brought in in a sheriff’s vehicle from her home,” Parachini said.

The celebrity inmate was sent home from the Los Angeles County jail’s Lynwood lockup shortly after 2 a.m. in a stunning reduction to her original 45-day sentence. She had reported to jail Sunday night after attending the MTV Movie Awards in a strapless designer dress.

She was ordered to finish her sentence under house arrest, meaning she could not leave her four-bedroom, three-bath home in the Hollywood Hills until next month.

City Attorney Rocky Delgadillo complained that he learned of her release the same way as almost everyone else — through news reports.

Then, late Thursday, he filed a petition questioning whether Sheriff Lee Baca should be held in contempt of court for releasing Hilton — and demanding that she be held in custody. Superior Court Judge Michael T. Sauer’s decision to haul Hilton back to the courtroom came shortly after.

“It is the city attorney’s position that the decision on whether or not Ms. Hilton should be released early and placed on electronic monitoring should be made by Judge Sauer and not the Sheriff’s Department,” said Jeffrey Isaacs of the city attorney’s office.

Sauer himself had expressed his unhappiness with Hilton’s release before Delgadillo asked him to return her to court. When he sentenced Hilton to jail last month, he ruled specifically that she could not serve her sentence at home under electronic monitoring.

Delgadillo’s office indicated that it would argue that the Sheriff’s Department violated Sauer’s May 4 sentencing order.

Paparazzi camp out at Hilton home
As word spread earlier Thursday that the 26-year-old poster child for bad celebrity behavior was back home, radio helicopter pilots who normally report on traffic conditions were dispatched to hover over her house and describe it to morning commuters. Paparazzi photographers on the ground quickly assembled outside its gates.

Hilton herself kept a low profile, although late in the morning a man arrived outside her house with a supply of cupcakes he said she had instructed him to distribute to the media horde.

Her parents also arrived and briefly entered, then left, the home.

Shortly before noon, Hilton issued a statement through her attorney.

“I want to thank the Los Angeles County Sheriff’s Department and staff of the Century Regional Detention Center for treating me fairly and professionally,” she said. “I am going to serve the remaining 40 days of my sentence. I have learned a great deal from this ordeal and hope that others have learned from my mistakes.”

Attorneys differed on whether her treatment was unusual.

“She would have gotten out early if she was plain Jane,” said Leonard Levine, who has handled numerous probation violation cases. He noted that overcrowding in the Los Angeles County jail system has led to thousands of nonviolent offenders serving only 10 percent of their sentences. “She did as much time as a normal person would have done.”

Loyola University law professor Laurie Levenson said that she suspected the deal for Hilton’s early release was in the works even before she entered the jail system — and that officials probably were anxious to get her out of their custody.

“The time and resources needed to take care of a Paris Hilton are huge,” she said. “They have to make sure she is safe and her medical needs are attended to. Everything they did was going to be looked at under a microscope.”

Levine said that with rewards being offered for pictures of Hilton in custody, jail officials would have had to monitor the cell phone cameras of every employee.

Rene Seidel of the Los Angeles County Department of Health Services said he had “never heard of” an inmate being released from jail for a medical condition.

Inmates with a cold are sent to a jail clinic, he said, and the seriously ill go to the jail ward of the Los Angeles County-USC Medical Center.

Hilton’s path to jail began Sept. 7, when she failed a sobriety test after police saw her weaving down a Hollywood street in her Mercedes-Benz on what she said was a late-night run to a hamburger stand.

She pleaded no contest to reckless driving and was sentenced to 36 months’ probation, alcohol education and $1,500 in fines.

In the months that followed she was stopped twice by officers who discovered her driving on a suspended license. The second stop landed her in Sauer’s courtroom, where he sentenced her to jail.

Her 'fame' is no more ridiculous than when we make local celebrities out of two brothers who own a furniture store or a guy who tells us the weather on TV.

Or, how about a detective turned author who botched an infamous murder case.

At one time, actors and actresses where looked down on by society.

I think she's famous because so many other people are so bored with their lives they are drawn to people who are actually different. Then the whole 'herd mentality' kicks in and when a few proclaim her fame worthy, the rest follow.

Paris Hilton was sent screaming and crying back to jail Friday after a judge ruled that she must serve out her sentence behind bars rather than in the comfort of her Hollywood Hills home.


"It's not right!" shouted Hilton, who violated her probation in a reckless driving case. "Mom!" she cried out to her mother.

Hours earlier, the 26-year-old hotel heiress was taken handcuffed from her home in a black-and-white police car, paparazzi sprinting in pursuit and helicopters broadcasting live from above. She entered the courtroom disheveled and weeping, hair askew, without makeup, wearing a fuzzy gray sweat shirt over slacks.

She cried throughout the hearing, dabbing her eyes, and her body shook constantly. Several times she turned to her parents, seated behind her in the courtroom, and mouthed, "I love you."

Despite being ordered to serve the remainder of her original 45-day sentence, Hilton could still be released early. Inmates are given a day off their terms for every four days of good behavior, and her days in home detention counted as time served.

Superior Court Judge Michael T. Sauer was calm but apparently irked by Sheriff Lee Baca's decision to release Hilton three days into her sentence due to an unspecified "medical condition."

"I at no time condoned the actions of the sheriff and at no time told him I approved the actions," Sauer said. "At no time did I approve the defendant being released from custody to her home."

The hearing was requested by the city attorney's office, which had prosecuted Hilton and wanted Baca held in contempt for releasing Hilton despite Sauer's express order that she must serve her time in jail. The judge took no action on the contempt request.

A member of the county counsel's staff said Baca was willing to come to court with medical personnel. The judge did not take him up on the offer.

Assistant City Attorney Dan F. Jeffries argued that Hilton's incarceration was purely up to the judge. "Her release after only three days erodes confidence in the judicial system," he said.

Hilton's attorney, Richard Hutton, implored the judge to order a hearing in his chambers to hear testimony about Hilton's medical condition before making a decision. The judge did not respond to that suggestion.

Another of her attorneys, Steve Levine, said, "The sheriff has determined that because of her medical situation, (jail) is a dangerous place for her."

"The court's role here is to let the Sheriff's Department run the jail," he said.

The judge interrupted several times to say that he had received a call last Wednesday from an undersheriff informing him that Hilton had a medical condition and that he would submit papers to the judge to consider. He said the papers never arrived.

Every few minutes, the judge would interrupt proceedings, state the time on the clock, and note that the papers still had not arrived.

He also noted that he had heard that a private psychiatrist visited Hilton in jail, and he wondered if that person played a role in deciding her medical needs.

The last attorney to speak was another deputy city attorney, David Bozanich, who declared, "This is a simple case. There was a court. The Sheriff's Department chose to violate that order. There is no ambiguity."

Hilton's twisted jailhouse saga began Sept. 7, when she failed a sobriety test after police saw her weaving down a street in her Mercedes-Benz on what she said was a late-night hamburger run.

Hilton screamed.

Eight deputies immediately ordered all spectators out of the courtroom. Hilton's mother, Kathy, threw her arms around her husband, Rick, and sobbed uncontrollably.

Deputies escorted Hilton out of the room, holding each of her arms as she looked back.

I couldn't believe it on the radio when I heard it earlier... I came home to Al Sharpton practically celebrating on the news... then I knew it was true.

Now she has to do all 45 days in jail instead of 23.

Wow.. she's having a bad day.

I heard yesterday that she was planning a big party last night and inviting all of her friends.... maybe the judge heard that too.

Pretty crazy stuff.

It doesn't matter who it is, this is making headlines around the world. Not only that, we should all be concerned regarding what kind of a person that teens look up to in this world.

Thumbs UP! Judge Sauer is setting a precedent! Good for him, all cities, counties and states should have open communications throughout their judicial systems. I believe the JUDGE is the one who makes the final ruling, and those under his direction should abide by the decision or be held in contempt.

If they dispute the ruling let them take it to the Circuit Courts, then on to the Supreme Court!

These theatrics out of a 26 year old are scary, to say the least. She will set an example for all of the young girls who want to be just like her.

Perhaps now, Paris Hilton will decide to grow up, er....more gracefully.

It doesn't matter who you are, abide by the law or go to jail!

I wouldn't wish to be in the car that gets hit by a drunk driver.

I wish that we all had a Judge Sauer in every courtroom across America! If you get involved in the legal system, it is quite dextrimental because not everyone is on the same page. Law enforcement officials need to learn to all get on the same page, from the same book.

The media needs to stop trying cases in the public realm. Do the crime. Do the time.

Judge Sauer is bringing integrity back to the bench! :bow:

The Hilton's should pay for a new jail or at least a new robe or gavel for this Judge for perhaps saving their daughter's life, or some else's child. Responsibility doesn't always come cheap.

A sobbing Paris Hilton???.......... there are severalmany parents across this nation that sob each and every day because their child is dead, killed by a drunk driver. They will never hear the words "Mom" or "Daddy" from them ever again.

Place her in the general prison population and she will grow up all the more rapidly.

There are actually innocent people in that jail, I am sure, that is doing someone else's time. Paris is guilty. She should have received a contempt of court for her behavior, after all, she is not in juvenile court. Perhaps this will allow her time to dry out. Life saved PLUS.

And of those imprisoned, many also had "medical conditions," just as Hilton reportedly had. In 2004, there were more than 6,000 people in prison with AIDS. That year, 204 of people with AIDS in prison died there.

Sheriff Lee Baca accepted a $1,000 campaign donation last year from William Barron Hilton—Paris's grandfather. That contribution constituted the maximum amount allowable under California campaign rules.
In office since 1998, Baca has cultivated close ties to the Hollywood community. Others who donated money to his campaign last year included Rupert Murdoch, Les Moonves, Ron Meyer, Brad Grey, Steven Segal, and Burt Bacharach. He was assailed last year over a claim by the Sheriff's Department that Mel Gibson had been arrested without incident, when the star had actually spewed anti-Semitic statements after getting pulled over for drunk driving. It soon emerged that Gibson had taped a public service announcement for Baca's relief committee.
