Exclamation Temporary President?

For those that is interested...find the info on Google (many of them).

Constitutional Law Professor Ken Katkin made a statement that is worth debating on the status of President the past week.

No, the oath is *not* legally meaningless, even if it is a ritual. Art. II Sec 1. Cl. 8 of the US Const. clearly states that “Before he enter on the Execution of his Office, he shall take the following oath. . . ”
This person said much more.

I'm a bit confused, but somehow, Rice was the President for a short time. Biden was also the President for a short time.

So, yeah, Obama did not qualify, since the oath was a complete failure, no matter how minor it was. (I still don't think Obama qualify for other reasons...)

Recap...

For the few minutes past noon, Rice was technically the President.

Pelosi never did resign her seat in Congress, so technically she did not qualify. That brings Rice as President.

Bush's time expired at noon. Rice was the Acting President.

As soon Biden completed his oath on Vice President, he soon became the Acting President for a short time, since Obama did not tehnically qualify on the oath issue.

Aye, confusing, I know.

Prue, care to clarify?

Does anyone know if Obama had taken the customary oath before the public oath?

Is there a difference between President and Acting President?

So, if Obama didn't follow the customary oath, it could be that Biden was actually the one as President and Rice never was, cuz she didn't take the oath.

Obama be President, but not Acting President until the oath was properly completed. That didn't happen for a while. During that time frame....the executive orders signed before completed oath (dont forget no bible the 2nd time)...

That's just stupid. John Roberts messed up and therefore so did Obama. Can't blame the man for following to the best of his ability what he heard.

How is it in your best interest for Obama to end up having to quit his job from not being qualified for it? After all, he would only be replaced by Biden who is just about as liberal.

Why worry about no bible being present the 2nd time around, if the constitution does not require it?

The fact is that the law is decided by judges. If this were ever, ever questioned who would decide the case? Justice Roberts. Who performed the swearing in? Justice Roberts. If a case was filed and his court accepted it for review how do you think they would rule?

Trust me, based on the above he was always president.

I agree that Obama was the President starting noon, but not yet the Acting President. From the time Biden sworn in until Obama retook 2nd oath, Joe Biden was the Acting President, according to what I've researched. During this time, I am unsure of what executive orders Obama had signed. It could be invalid and that Biden was the Acting President at the time. Someone could challenge that in court.

It seems that Obama had broken another tradition by not taking the customary oath before the public oath service. This shows when Obama retook the oath the next day.

This isn't the first time that oath was misspoken during an inauguration. Needless to say, it doesn't mean anything. Move on.
