Default Drunk Hit & Run--at OUR HOUSE!

This is a repost from another forum--this happened to my in-laws this past Sunday morning.

So I am an avid visitor to this site, and rarely post. However, this morning around 3:45am my wife awoke to a "crash," and then noticed a hispanic man running through our front yard at a rapid pace.

Well, then she noticed the 93 Honda Accord flipped on its side, that had struck 3 of my in-laws cars (totalling 1) BUT IT MISSED MY MUSTANG! I usually park in the rear of the driveway, and had I tonight my car would be totalled as well.

This little accord pushed 3 cars about 10 feet into a tree--needless to say he was moving fast. We live on a tight corner, and witness many wrecks but this one was a bit too close to home!

Update--we have the police report and know the guy's name and address...BUT get this crap:

The police can only send a letter to the address "asking" them to come to the station for questioning and informing them their car was in an accident.

They CAN'T even go the this guy's house, NOR can they even ask if he has insurance! What kind of BS is this?

So, my in-laws are in touch with a lawyer currently, and FYI both cars were totalled.

***My question, what are our options here? Sure the attorney will help, but legally, is there anything we can do? And why can't the cops act? This guy was drunk, left the scene of a crime, and caused $15,000 damage.

Several years ago, I had something similar happen. One night, at around 11 PM., my wife and I were already in bed, and my son had just gone to bed.

Suddenly, we heard a loud bang outside (we live on the corner of a busy street), and about that time, my son came in to our room, and in a real calm voice said that somebody just crashed through our fence.

He said he was just lying there about to go to sleep, when he heard tires squealing. The next thing he knew, he heard a crash and a set of headlights were shining right at his window. That's when he came to get me.

By the time I got to his room, the car had left. I stepped outside and was shocked at what I saw. The car had jumped the curb, went airborne, and crashed right through our fence. If the fence had not been there, the car would have gone through my sons wall...right where he had been lying down.

As I looked a little further, it seemed as if the car was leaking oil. Evidently, when he jumped our fence, he punctured his oil pan. I looked down the street, shined my flashlight, and saw a trail of oil. I called the police. It just so happened that the officer that came out was a guy that I graduated from high school with.

Several officers followed the oil trail and found the car. The officers said they checked the cars hood and it was hot. They could smell burning oil. They approached the porch and talked to the male and female that were there. They told the officers that they had been at the house all evening and they were having car trouble. Even though there was no doubt that this was the car involved, we could not press charges, because we did not witness it. If someone had witnessed it, we could have done something about it.

My neighbor across the street was half way drunk, so his statement to the police did not hold water. He saw it happen but he couldn't be sure what the car looked like. So, I had to clean up an oil spill in my yard, and I took the rest of the fence down.

How horrible... I can't believe they can't do anything to get this guy. I think your insurance company should try to track him down.. but chances are, he doesn't have insurance.

How about small claims court for damages?

Well about 13 yrs ago lived in apts around 89th & S Western...Around New Years and around 10 degrees...Woke up around 2 to a loud bang outside...Looked down from the window and saw a car had crashed into the one next to mine which pushed the parked car right into mine...Saw someone get out and run across the field....Presumed it was the driver

After a few choice words went outside to survey the damage.....Walked to the side and the driver suddenly looked up...Scared the sh** out of me...His lame a** got out and ran thru the field as well

Long story short...Car was supposedly taken w/o permission and no insurance...Thinking the freakin car retailed for about $250....Real nice one

Guess the drunk fool tried to park the car at around 30 mph...Gotta love alcohol

Thanks for sharing your stories. Glad to know we're not the only one to deal with a situation like this. It is just unbelievable how helpless we feel, if the guy would have been caught he would no doubt be spending some time behind bars.

BUT, since he ran, we have no proof. I am sure he has no insurance, but we will just have to wait and see what (if anything) the investigation brings.

Problem though, my inlaws only have liability insurance. We have already thought about small claims (but isn't the limit $5,000?)...

It's been awhile, but i think I just had liability as well and was just out of luck and had to fix the damage myself...Gotta love some of our fellow citizens

Took some satisfaction out of knowing these losers will probably stay that way until they die ...At least that's how I finished the story to make me feel better about it

I think it's crazy that the police can't go to the car owner's house! What ever happened to good detective work?

I assume you have a photo of the license plates, since you have one of the car itself...
